OM Human Resource Agency Private Limited (“OmHRA”, “we”, “us”) is a staffing and workforce solutions company in New Delhi, India. This policy explains what personal data we collect, why we collect it, who we share it with, how long we keep it and the rights you have. It applies to candidates, our employees and deployed workers, client contacts, referrers and visitors to omhra.in. We process personal data in line with the Digital Personal Data Protection Act, 2023 and the rules made under it, and other applicable Indian law.
1. What we collect
- Candidates: name, contact details, CV, education and work history, skills, current and expected salary, notice period, location preferences, and interview feedback.
- Employees and deployed workers: identity and address documents, PAN, bank details for salary, PF and ESI details, attendance and leave records, payroll and tax records, background verification results, and nominee details.
- Client contacts and partners: name, job title, business contact details and records of our communication.
- Referrals: the name, phone number, CV and job interest of the person you refer, and your own contact details.
- Website visitors: basic technical data such as browser type and pages visited, through cookies or similar tools, and the details you submit through our contact form.
2. Why we use it
- To match candidates with job opportunities and share profiles with prospective employers, with the candidate’s consent.
- To employ and pay our employees and deployed workers, and to meet our obligations under labour, tax and social security laws.
- To carry out background verification before deployment, with the individual’s consent.
- To provide our services to clients, including payroll and Employer of Record services.
- To respond to enquiries, process referrals and improve our website.
We process personal data on the basis of your consent, or for legitimate uses permitted by law, such as employment purposes and compliance with legal obligations. You may withdraw consent at any time by writing to our Grievance Officer. Withdrawal does not affect processing already carried out, and we may not be able to continue a recruitment process or service without the data it needs.
3. Who we share it with
- Clients and their managed service providers: candidate profiles for roles you have agreed to be considered for, and worker records needed to manage a deployment.
- Service providers who work on our behalf: background verification agencies, payroll and HR software, applicant tracking and messaging tools, banks, insurers and cloud hosting. They may use the data only to provide services to us.
- Government authorities: such as the EPFO, ESIC and tax authorities, where the law requires it.
We do not sell personal data. Some of our service providers may store data outside India; where they do, we transfer data only as permitted under Indian law.
4. How long we keep it
We keep candidate profiles for up to 3 years after our last contact, so we can consider you for future roles, unless you ask us to delete them sooner. We keep employment, payroll and statutory records for as long as labour, tax and social security laws require. When data is no longer needed, we delete or anonymise it.
5. How we protect it
We follow documented information security policies covering access control, encryption, endpoint security and incident response. Access to personal data is limited to people who need it for their work, and our systems use multi-factor sign-in. If a personal data breach occurs, we will notify affected individuals and the authorities as the law requires.
6. Your rights
You have the right to:
- get a summary of the personal data we hold about you and how we use it
- ask us to correct, complete or update it
- ask us to erase it, unless we must keep it by law
